菲爾·亞伯拉罕 : 規(guī)范性文件備審查制度是一重要的憲法性度。對規(guī)范性件進行備案審，是憲法、法賦予各級人大委會的一項重職權(quán)，是保證中央令行禁止保障憲法法律施，保護公民法權(quán)益，維護家法治統(tǒng)一的項重要工作。2023年1月10日，山東省十三屆人大常委第四十一次會召開，聽取并議了法制工作員會關(guān)于省十屆人大以來暨2022年備案審查工作情況的告。省十三屆大以來，在省大常委會領導，法制工作委會堅持以習近新時代中國特社會主義思想指導，全面貫習近平法治思，按照“有件備、有備必審有錯必糾”的求，依法履行責，積極開展案審查工作，實發(fā)揮了備案查制度保證黨央令行禁止、護國家法治統(tǒng)、保障公民合權(quán)益的功能。措并舉，審查量穩(wěn)步提高省三屆人大以來共接收報送備的規(guī)范性文件431件。在審查中嚴格把握審標準，重點圍是否與黨中央重大決策部署符合以及是否國家的重大改方向相一致，否與上位法相觸，是否存在當性問題等，規(guī)范性文件進全面審查。充借力外腦。針規(guī)范性文件涉領域廣、部分件專業(yè)性較強現(xiàn)實情況，積尋求智力支持累計將400余件規(guī)范性文件送給立法顧問地方立法研究務基地等協(xié)助查，收到各類見建議近200條，切實保證審查質(zhì)量。在人承辦、集體論等工作程序礎上，堅持重規(guī)范性文件和查中發(fā)現(xiàn)的重難點問題由法工作委員會委會集體研究決，將“有備必”要求落到實?；貞P(guān)切，查建議“一鍵達”根據(jù)審查議，對規(guī)范性件進行的審查是備案審查工的重要方面，于促進依法行，維護公共利和社會秩序，護公民、法人其他組織合法益，具有重要義。法制工作員會在接收書審查建議的同，不斷暢通人利益表達渠道在備案審查綜信息平臺開通民審查建議“線提交”功能人民群眾參與案審查熱情大提高。省十三人大以來，法工作委員會通備案審查信息臺、書信等形共收到公民、織提出的各類查建議50件。為做好審查建辦理工作，法工作委員會加與建議人和有部門的溝通，次征求省政府公廳、省司法、有關(guān)設區(qū)的人大常委會法委等有關(guān)方面見，了解文件定依據(jù)，對審建議逐一進行究，提出處理見，并向建議認真反饋，切做到民有所呼我有所應，在案審查工作中分踐行全過程民民主。定期理，破除無效度束縛為貫徹中央重大決策署、配合重要律、法規(guī)修改落實全國人大委會相關(guān)要求，法制工作委會定期有重點對某類規(guī)范性件進行專項清。2018年，組織了對符合送省人大常委備案條件的所現(xiàn)行有效規(guī)范文件的全面清，各有關(guān)機關(guān)清理規(guī)范性文766件，其中，省政府規(guī)章202件，設區(qū)的市人大常委會范性文件245件，設區(qū)的市府規(guī)章292件，其他規(guī)范性件27件；通過清理，各機關(guān)修改、廢止、布失效規(guī)范性件77件。2019年以來，先后圍繞落實“管服”改革、化營商環(huán)境、生動物保護、及行政處罰、劃生育、水資開發(fā)利用等領開展了專項清，將71件規(guī)范性文件列入了改、廢止計劃通過組織規(guī)范文件清理，有督促各文件制機關(guān)對現(xiàn)行有規(guī)范性文件進系統(tǒng)、全面梳，對存在合法、適當性等問的規(guī)范性文件時修改、廢止宣布失效，破了無效制度束，適應了改革展要求，切實護了國家法治一。有錯必糾不斷強化監(jiān)督性落實“有錯糾”，發(fā)現(xiàn)并正存在問題的范性文件，是案審查實現(xiàn)其度功能的重要現(xiàn)，對備案審制度有效運行實現(xiàn)糾錯功能義重大。省十屆人大以來，制工作委員會過溝通、協(xié)商函詢等方式，斷增強工作剛，先后發(fā)出提函18件、督促函17件、征求意見函20件，督促文件制定關(guān)對存在問題25件規(guī)范性文件進行了糾正,其中，與國家大改革方向和委工作安排不致的1件，超越權(quán)限違法設定民、法人和其組織權(quán)利與義的8件，違法設定、變更行政可的7件，違法設定、變更行處罰的6件，存在其他不適當題的3件。2件案例被《規(guī)范文件備案審查例選編》一書錄，1件案例被《法治日報》發(fā)，13件案例被全國人大常會法工委工作報及公眾號轉(zhuǎn)。協(xié)同推進，市縣“兩個全蓋”出臺相關(guān)度，實現(xiàn)規(guī)范文件備案范圍覆蓋。積極推將監(jiān)察委員會人民法院、人檢察院有關(guān)規(guī)性文件納入同人大常委會備審查范圍。自2020年起，通過座談交流、織調(diào)研、溝通示等方式，積推動“一委兩”在備案范圍工作機制等方達成共識。2021年11月15日省十三屆人大常委會主任議第76次會議研究決定，將監(jiān)察委員會、高級人民法院省人民檢察院關(guān)規(guī)范性文件入備案審查范。2019年，建立了備案審工作情況報告度，法制工作員會已連續(xù)三向省人大常委報告?zhèn)浒笇彶?作。同時，指和推進市、縣級人大常委會實該項制度。據(jù)各市實際情，安排專人定跟進，逐一梳市、縣兩級人常委會開展該工作的時間、式，建立工作賬，掌握工作度，并對報告式、審議方式進行指導。2022年，地方組織法修改后，16個設區(qū)的市人大常委會發(fā)了《關(guān)于進一規(guī)范落實備案查工作報告制的通知》，對作開展情況進通報，并對報形式、審議方等提出了具體求，確?！叭?蓋”目標落實地落細。截至2022年底，全省16個設區(qū)的市和136個縣級人大常委會已實現(xiàn)規(guī)范性件備案范圍和告工作“兩個覆蓋”。雙擎動，數(shù)字賦能升質(zhì)效扎實推備案審查信息建設，跨入備審查工作信息智能化發(fā)展“車道”。2019年，開發(fā)建成備案審查綜合息平臺，按照法與備案審查一盤棋”的設理念，在設置案審查相關(guān)業(yè)版塊的同時，步拓展立法相功能，目前該臺在全國同類臺中是功能較、覆蓋面比較的。平臺建成，得到全國人常委會法工委規(guī)備案審查室分肯定，多家體進行了深入道。2022年，開發(fā)建成了能立法平臺，針對性地設計智能比對、立智庫、大數(shù)據(jù)析等八大系統(tǒng)能版塊，有效補備案審查綜信息平臺功能板，極大地提了規(guī)范性文件查工作質(zhì)量和率。2022年9月召開的全國人大信息化工交流會上，我平臺建設經(jīng)驗為典型案例被國人大轉(zhuǎn)發(fā)推。習近平總書在黨的二十大告中指出，完和加強備案審制度,這是黨的全國代表大會告中首次對備審查制度建設出明確要求。制工作委員會堅持以習近平時代中國特色會主義思想為導，全面貫徹的二十大精神堅持和發(fā)展全程人民民主，續(xù)深入開展備審查工作，為代社會主義現(xiàn)化強省建設貢力量。閃電新記者 廖亮 ?報道 山東人大 山東省人民代表大會常務委會辦公廳 編輯： 廖亮 黃鵬偉 閱讀量：1354

The papercutting art was developed over 2,000 years ago, and it is the most widespread and most popular folk art with the longest history and the most extensive producers. It has been passed down to the present.Wang Yanchang's hometown is in Dayu Island of Shidao District. The spectacular rise and fall of the sea, strong fishermen and beautiful fisherwomen, all these are deeply imprinted in his mind and turn into the inspiration for his papercutting art.The image of fishermen is very good, fishermen are very strong and fisherwomen are very beautiful. I was very familiar with the life of fishing village in old days, as well as the fishing process. I have created a lot of fishermen's life works, with figures in the works mending the nets and setting net undersea.?The unique natural and cultural landscape of Dayu Island has attracted many art students from colleges and universities across the country to sketch there every year since the 1950s and 1960s.The Central Academy of Fine Arts in Beijing listed Dayu Island as an internship base, so does the China Academy of Art in Hangzhou as well as LuXun Academy of Fine Arts in the northeast of China. Therefore, most of the famous painters in the country have visited Dayu Island. I learned painting from them during that period of time.During that time, Wang Yanchang practiced papercutting skill while learning painting, so that his art works had improved a lot. However, in order to have the ultimate choice of artistic pursuit, many papercutting artists have turned to painting, which was easier to become famous compared with papercutting because of its effortlessness. However, Wang Yanchang was still interested in papercutting.Many people think that papercutting is a petty skill, but I don't think so. Papercutting can fully express big themes. Nowadays more and more painters or literati tend to get involved, we can’t be limited to cutting cats or dogs, nor flowers or plants. We have to do some creation through papercutting.Wang Yanchang's papercutting craft is becoming more and more mature. The composition, color and lines are flexible and varied, which can draw people’s great attention. Each piece of work appears to be well-conceived and well-handled, which can be fully expressed to people’s heart’s content. Some people think that papercutting can only express physical emotions, not facial expressions. Wang Yanchang, on the other hand, believes that the art of papercutting should be developed from multiple perspectives and learned from each other with painting and woodcut painting. The delicate and rich facial expressions in his papercutting works have formed a unique feature in his personal style, making the art form of papercutting richer and more vital.These works of Mr. Wang Yanchang can be told at only a glance, because his style is delicate and represents the cultural customs of the local region. It is very attractive, very worthy of pondering, and has the content of life as well as the breath of life.I have been to France, the UK and Germany to hold exhibitions. Last time when I was in the UK, I gave three lectures. With wide report by British TV program, some people drove from over 200 miles away to attend the lecture. The highlight of their report is that the Chinese papercutting expert can make paint with paper which can be lifted up for a better vision.The love for hometown is the source of inspiration for Wang Yanchang's papercutting art. Wang Yanchang is now the Deputy Director of the Papercutting Art Committee of the Chinese Culture Promotion Society. Under his great efforts, the 2018 National Excellent Papercutting Exhibition was held in Rongcheng, Weihai City.
